Alternative Solutions For The Mistrals




Some solutions such as selling the Mistrals to NATO, the EU or even waiting to seize the Mistrals to pay the fine Russia owes in the Yukos case often appeared in the media these last months. Here are the most advanced propositions or articles about those:

1) European Union: Resolution/Proposal for the E.U to purchase Mistral ships:

"The proposal for the European Union to purchase Mistral ships from France is welcomed in Brussels and is a way out of a particularly complex situation, says Arnoldas Pranckevicius, External Policies Advisor to the President of the European Parliament.
Pranckevicius says that no concrete decision regarding this proposal has been made yet.

2) N.A.T.O and Canada: One of the Mistrals for NATO, the other one for Canada:

"After transferring ownership of the program to NATO, the first Mistral building for Russia, now completing at the STX Europe shipyards in Saint-Nazaire, France, would enter Alliance service on schedule in 2015, based in Europe and manned by a French-heavy multinational crew representing most member states. The second Russian Mistral — slated for delivery in 2016 — would be operated by the Royal Canadian Navy on a renewable five-year lease, based on the East Coast at Halifax. Under terms of the lease, this LPH would share commitments between NATO and Canadian national taskings."

"In July, Russia has been condemned to a 50 billion dollars fine by the court in The Hague in the Yukos case. The deadline to pay this fine is the 15th of January 2015. Could the Mistrals be seized to pay the fine if Russia fails to pay in time?"

4) Legal grounds: How the deal could be cancelled using the "Force Majeure" clause:

"That greater force covers external reasons for canceling a delivery, with “war (whether declared or not), armed conflict or the serious threat of same…” leading the factors listed in the ICC note. If France decides against delivery, prime contractor DCNS could evoke force majeure on the grounds the interministerial commission for arms export had refused to grant the export license. After 180 days — generally the suspension period — DCNS could cancel and would have to repay Russia for the ship. The two sides would then go to a tribunal to decide how the payment would be made."
